1. Acceptance of Terms & Conditions

1.1 These terms govern your use of the hdenergy.co.uk website ("the Website"). Please read the terms carefully. By entering this Website you acknowledge that you are bound by these Conditions. If you do not wish to be bound by these Conditions please exit the Website.

1.2 The services offered on the Website consist of:
Supplying copies of your personal details and employment history ( “CV” ) (i.e. summaries of your training, skills, employment and education compiled for the purposes of obtaining employment in the format specified by surveyorjobs.net) to prospective employers as and when requested by employers (the "Service"); and

2. Intellectual property
2.1 The copyright and all other intellectual property rights in the contents of the Website belong (or are licensed) to hdenergy.co.uk and except as detailed in 2.2 below, the contents of the Website may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form whatsoever, or by any means.

2.2 You may permit your computer to make an electronically stored, transient copy of the contents of this Website only for the purpose of viewing it while connected to the Internet. You may only make one copy of any contents and will not use such copy in any commercial manner.

3. Candidate's obligations

3.1 You shall provide CVs in the format specified and shall up date them as and when the information in the CV (or any of it) contained therein becomes out of date or inaccurate.

3.2 You warrant that all information that you provide to us in relation to your cv or otherwise:

(a) is true and accurate;

(b) is not offensive, discriminatory, obscene, defamatory or in any other way illegal; and

(c) does not infringe any rights of any third party (including without limitation the copyright of any such third party).

3.3 You will indemnify us for any losses or liabilities we may suffer or incur due to the content of any information you provide to us.

4. Information Requests

4.1 You shall use all reasonable endeavours to respond promptly to any requests for guidance, instruction or information and any other form of assistance reasonably required by hdenergy.co.uk to enable it to perform the Service.

5. Limitation of liability

The service is free of charge and therefore:

5.1 we do not limit our liability for personal injury or death caused by negligence;

5.2 we shall not be liable for:

(a) any losses you may make which result from your use (or inability to use) the Website (including any damage to your hardware or software due to any viruses or cookies);

(b) inaccuracy of any job details, the unavailability of the job in question or the activities or conduct of any potential employer or party who places an advertisement on the Website;

(c) any lost data and, accordingly, you should keep a separate record of any details you enter into the Website;

(d) interruptions or restrictions in access to the Website or any delay, costs, damage or other loss (including without limitation loss of profits) howsoever caused arising from any matter beyond the reasonable control of surveyorjobs.net.

5.3 The Website may contain technical inaccuracies and/or typographical errors. We accept no responsibility as to the accuracy, completeness, suitability or fitness for purpose of any material on, or the reliability of access to this Website (or any website that is, or may become, linked to the Website) or for keeping material up-to-date or any liability resulting from its failure to do so.

5.4 We reserve the right, at our discretion, to amend or delete any information you have entered into the Website.

5.5 In carrying out the Service or providing the Additional Services surveyorjobs.net may use information provided to it by you and/or third parties (including prospective employers). hdenergy.co.uk will use all reasonable endeavours to ensure the reliability of any third party sources but hdenergy.co.uk accepts no liability for the accuracy of the information (in particular the information set out in advertisements or vacancies) which prospective employers provide.

5.6 hdenergy.co.uk makes no warranty or representation that it has verified any of the material on this Website or has vetted any prospective employer.

5.7 Subject to condition 5.4, all advice and information supplied by hdenergy.co.uk under the Service will be supplied in good faith but hdenergy.co.uk gives no guarantee as to any advice or information it supplies nor that following submission of your CV to any prospective employer, that you will be interviewed or employed or you will receive a response, or that you will be suitable to meet the requirements of that employer.

5.8 Nothing herein shall impose any liability upon hdenergy.co.uk in respect of any defect in the Service or Additional Services arising out of the acts, omissions, negligence or default of you or a prospective employer including in particular (but without prejudice to the generality of the foregoing) any failure by you to comply with any recommendations of hdenergy.co.uk and any errors, omissions inaccuracies or other defects in any CVs provided by you.

5.9 You shall indemnify hdenergy.co.uk in respect of any costs, claims, demands or expenses incurred by hdenergy.co.uk and for which it may be liable to any 3rd party including (but without limitation) infringement of any 3rd party rights (such as intellectual property rights) due to or arising from your acts, omissions or defaults or the submission by you of any inaccurate misleading unlawful or defamatory statement in a CV.

6 Cancellation

6.1 hdenergy.co.uk reserves the right at any time to remove a CV from the hdenergy.co.uk site in the event that hdenergy.co.uk considers that the CV breaches any applicable laws or the rights of any third party or is prejudicial to the interests of hdenergy.co.uk.

7 Data Protection

7.1 We are registered under the UK Data Protection Acts 1984 and 1998 and strive to operate within those Acts at all times. Our privacy statement forms part of these terms.

8 General

8.1 No waiver by either of us of any of these requirements or of any of our rights hereunder shall release the other from full performance of the remaining obligations.

8.2 Nothing herein shall be deemed to constitute, evidence or compromise a partnership between us nor to constitute either of us the agent of the other.

8.3 Should any provision of these Conditions be void or voidable the existence or avoidance thereof shall not prejudice the enforceability of the remaining provisions hereof.

8.4 Our agreement in relation to the Services and the Additional Services, incorporating these Conditions, shall be governed by and construed in accordance with English law and you hereto agree to submit to the non-exclusive jurisdiction of the English Courts.
8.5 A person who is not a party to the agreement between hdenergy.co.uk and the Candidate has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of there Conditions but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
 

Privacy Statement:

The following statement has been prepared to demonstrate our commitment to safeguarding the privacy of our users.
hdenergy.co.uk allows users to submit their personal details and employment history ("CV") to its database. The principle objective of this privacy statement is to explain how we will use this personal information.
Users can store their CV on our database for two reasons:


1. To simplify the process of applying for a job online but exclude it from our searchable database. If a CV is excluded from our searchable database we will not reveal any personal information you give us to any third party.
2. To include their CV within our searchable database which will allow a recruitment agency (which has been granted access) to view their personal details.

The user can remove (or modify) their CV from our database at any time by visiting our website. However, prior to its removal, copies of that CV may have been retained by our subscribers and we accept no responsibility for loss of privacy in these instances.


As a rule, employers are not given direct access to our searchable database of CVs. However, whilst we will endeavour to keep your information secure, users must understand that the internet is not a safe method of communication or storage of information and we accept no responsibility if a third party gains access to personal information through no negligence, fraud or willful default on our part.


Gaining access to CVs within our database is achieved by supplying us with an email address and a password. This information is exclusive to the user and must be kept safe at all times. Whilst we endeavour to keep our systems secure, we accept no responsibility for any security breach which results from a third party gaining access to a user's email address and password through no negligence, fraud or willful default on our part.
hdenergy.co.uk may employ the use of "cookies" which improve the performance and speed of our website. A cookie is a small file which is placed on the hard drive of the user's computer so that we can recognise that user each time he or she accesses our site. If you do not want us to place a cookie on your hard drive, please adjust your browser accordingly. Please note that this may well hinder the performance of the site.
We are constantly gathering demographic information about our users and may anonomise this data for research purposes.
